SKYWALL1.Acceptance of terms
These Terms are an agreement between you and Simple Products Labs LLC ("we", "us"), the developer of Skywall (the "App"), not with Apple Inc. If you do not agree to them, do not use the App.
2.License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules, subject to these Terms.
- As is: the App is provided "as is", subject to Section 7 (Your statutory rights)
- No reverse engineering: you may not reverse engineer, decompile or disassemble the App, except as permitted by applicable law
- Family Sharing: where Apple makes it available, other accounts in your family group may use the App as permitted by the App Store Usage Rules
- No redistribution: you may not redistribute, sell or sublicense the App
3.Purchase and refunds
The App is sold through the Apple App Store as a one-time purchase, with no subscription and no in-app purchases. Your purchase is processed by Apple, and refunds are handled by Apple under the App Store's terms: you can request one at reportaproblem.apple.com. We cannot issue refunds directly. Nothing in this section limits any withdrawal or refund rights you have under the laws of your country.
4.Channels and third-party content
The App shows live streams that broadcasters publish on YouTube, played through YouTube's official embedded player with the broadcasters' own ads and branding. We do not host, record, modify or own any of this content, and the App does not remove or block ads.
- Your viewing through the player is also subject to the YouTube Terms of Service and the Google Privacy Policy
- Broadcasters decide when their streams are live, and may end streams, restrict them by country or disable playback outside YouTube at any time
- We do not guarantee that any particular channel, country or category will be available, live or continue to be offered
- Channel names, logos and content belong to their respective owners. Channel descriptions come from Wikidata and Wikipedia under the CC BY-SA license
- Skywall is independent and is not affiliated with, endorsed by or sponsored by YouTube, Google or any broadcaster
5.Your responsibilities
- You will use the App only for lawful purposes and in line with the laws that apply to you
- You will respect the terms of YouTube and of the broadcasters whose content you watch
- You will not use the App to record, copy or redistribute content in violation of copyright
- If you are under the age of majority where you live, you may use the App only with the permission of a parent or guardian. Live channels are not filtered for age; parents can use Apple's Screen Time and Content & Privacy Restrictions
6.Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied. We make no warranty about the availability, accuracy or quality of any channel or stream, uninterrupted operation, or compatibility with your particular device, TV, cable, adapter or network. See Section 7 for rights that cannot be excluded.
7.Your statutory rights
Some jurisdictions, including the European Union, the United Kingdom and Australia, give consumers rights that cannot be waived by contract. Nothing in these Terms excludes or limits any consumer guarantee, right or remedy that cannot lawfully be excluded, or our liability for death or personal injury caused by our negligence, or for fraud. Sections 2, 6 and 8 apply only to the maximum extent permitted by the law of your country of residence.
8.Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for damages arising from the use of or inability to use the App, from third-party content or services, or from the unavailability of any channel. Our total liability to you for all claims will not exceed the amount you paid for the App.
9.Termination
We may end the license granted under these Terms if you materially breach them. The App has no accounts, so termination means your right to use it ends; it does not remotely disable your copy. Sections 4 through 8 and 10 through 13 survive termination.
10.App Store terms
The App is distributed through the Apple App Store, and the following also apply:
- These Terms are between you and Simple Products Labs LLC only, not Apple. Simple Products Labs LLC, not Apple, is solely responsible for the App and its content
- Simple Products Labs LLC, not Apple, is solely responsible for maintenance and support of the App; support requests go to support@screencommand.app. Apple has no obligation to provide maintenance or support
- If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the App
- Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, consumer protection or intellectual property claims. Simple Products Labs LLC is responsible for investigating, defending, settling and discharging any such claim
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties
11.Changes to these terms
We may update these Terms from time to time. Changes will be posted on this page with a new "Last updated" date. Continued use of the App after changes are posted means you accept them. Changes apply going forward only and do not affect rights that cannot be excluded by contract.
12.Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules, and disputes will be subject to the courts located in Wyoming, except where the law of your country of residence gives you the right to bring proceedings at home. These Terms were written in English; translations are provided for convenience, and if a translation differs from the English version, the English version governs.
13.Entire agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and Simple Products Labs LLC about the App. They do not affect your separate agreement with Apple for your App Store purchase. If any provision is found unenforceable, the rest remain in full force.
